How can you arrest someone if no charges have been filed?

It is definitely an eyebrow raiser that here we are on the 5th anniversary. I mean, he's been gone and away from her out of college for many years (where I could imagine she might feel intimated about him, or the football program, or the school). How this long later do you ever resolve the he-said/she-said that make these situations so difficult in the first place? I can only hope that in the hearts of both Adam and the female that they are both open and honest with the facts to provide justice.

I asked the exact same thing in one of the Facebook groups.... I think that they mean they are not sure if the charges will result in a trial, at least that's the only thing I can think of.

I don't know CPJ personally, but we've seen him kick guys off the team for far less serious transgressions. CPJ has a daughter, and I seriously doubt he would cover anything up just so his best DL (at the time) gets more snaps. Keeping Gotsis on the team if this was could jeopardize the program would be against the kind of person he's shown himself to be...at least in public.

100% agree CPJ wouldn’t allow it. I just hate seeing this stuff from the time he was playing at Tech. I’d be willing to bet no one on staff had any knowledge of it but with all the cover ups going on at programs it’s sometimes can raise an eyebrow.

The evidence must be pretty strong for any warrant to be issued. That says nothing about whether the case will stand up when the prosecutors look at it. As Whiskey says, the main problem here is the age of the offense. That alone makes prosecution a lot more difficult. We'll see what the DA decides to do.

Side comment, but has a purpose. If you never have sex with anybody other than your husband/wife, you’ll never have to worry about he-says/she-says. I’m not saying they did or didn’t, just food for thought...

DNA residue? A child? If either exist, only proves coitus took place. Not that a rape happened.

Most rape victims don’t file charges. Fewer than half report. There is a lot of pressure on women not to report. That a woman waited to report might just mean that she sees reporting as adding insult to injury.
Sometimes they don’t think the police will help. Sometimes they don’t want their family and friends to know.
About 12% lead to an arrest. Since 3% lead to conviction, an arrest means the odds are already a lot worse.

Former Georgia Tech football player Adam Gotsis has been charged with strongarm rape for a sexual assault alleged to have taken place in March 2013, when he was enrolled at Tech. Through his attorney, Gotsis maintained that the allegations are false.

Gotsis has been a defensive lineman for the Denver Broncos since he was drafted by the team in April 2016. According to police, the alleged victim came to Atlanta police in February of this year to report a sexual assault, which she stated occurred after she and Gotsis met through a mutual friend and attended a party together March 9, 2013. After the party, Gotsis took the alleged victim to his home and raped her, according to the statement given to police.

Last Wednesday, investigators secured a warrant for Gotsis, who turned himself into Fulton County jail the same day. He was released on $50,000 bond the same day.


Gotsis’ Atlanta-based lawyer, Sara Becker, said in a statement that Gotsis first became aware of the accusations in February.

“We immediately reached out to law enforcement and have proactively cooperated with all aspects of the investigation while maintaining communication with the team,” Becker’s statement read. “While we were disappointed to learn of the turn the investigation was taking, we steadfastly maintain that the allegations are false. We will continue to advocate strongly for Adam's innocence.”

A Tech spokesman said that the school learned of the arrest Monday and had no more information, directing further questions to the Atlanta Police Department.

You can accuse anyone of anything. Proof is not necessary for an accusation and, in the current social media rich environment, not expected.

Well actually...we’ve never met but I could falsely claim you assaulted me anyway. I get your point though and it certainly has merit.

But a 5 year old case. Physical evidence is not likely to exist. Even photo evidence of injuries hypothetically would be subject to extreme scrutiny.

Without more info, the only way I see them having solid PC is through a confession. Her allegation plus hypothetical corroborating testimony “she told me he raped her (the day of or very next day), she was visibly distraught, and I saw her injuries”....would be very weak PC even if he refused to cooperate with investigators prior to arrest. Just imo.

Anecdotally, a fairly high number of rape allegations are unfounded.
