Well … not really. What the NLRB did was decline to exercise jurisdiction. That's sorta like the Supremes declining to grant cert for a case. That is often reported as " … the Court upheld a ruling …". They didn't; they just refused to hear the case. Same deal here. The issue was due to the NLRB not being able (supposedly) to address issues involving state-run universities. This is far from over.

This is relatively small potatoes compared to the Kessler antitrust suit. That's the one that would bring the NCAA to its knees.
