Once again, the two issues are intertwined. If the ACC were to refuse any attempt to repurchase the media rights it essentially prevents FSU from existing. That would be challenged legally. As much as you guys want the ACC to attempt do this, they aren't going to. They even mentioned FSU...
Not contractually obligated but the alternative is years of lawsuits and an eventual court ruling. It would be interesting to see the ACC argue in court that they have a legal right to prevent FSU from leaving the ACC which is against their own bylaws.
We are all out of our element here. No one to my knowledge here has claimed to be a lawyer. We are all going off of analysis by actual lawyers elsewhere or our intense hatred of FSU and what we want to be true. Some here think the GOR gives the ACC the right to hold FSU hostage or extort them...
Im not saying that FSU or the Big 10 would attempt this, nor do I think that the ACC would ever try to hold FSU hostage or attempt to extort them. Just saying what measures might come next if the ACC wanted to go this extreme route. It would all end up in court eventually.
What im arguing is that you can't say the ACC bylaws clearly spell out how to leave the conference when no program can actually leave the conference because of the GOR. Its a decision of staying and continuing to exist or leaving and shutting down your football program because you will not be...
You can't argue that FSU can leave but they have to leave their media rights behind. That obviously doesn't make any sense. Their athletic department can't function without media rights nor would any other conference take them without media rights. Therefore they can't actually leave. In reality...
I mean, if the ACC tried this then FSU would just leave the conference, and refuse payment back to the ACC. Everything will stay in court for years and years. They run a serious risk at that point of getting far less then they could get in a settlement.
They are subject to interpretation because interpretation is actually in the bylaws. What you conveniently left out is that part about otherwise deemed material by the chair or commissioner. Assuming money in the current contract doesn't change, which is actually arguable in this case because...
Another interesting article about the coming bidding war for financing that will include money for FSU's buyout:

Seems pretty clear from their Project Osceola presentations that they...
It goes to the fiduciary responsibility argument. Why even have a clause in your bylaws that requires a membership vote if the commissioner can just ignore it when he feels like it? The argument that the GOR completely voids any fiduciary responsibility for the ACC and supersedes all ACC bylaws...
The ACC filed a complaint asking for declaratory judgement saying the grant of rights is enforceable, and that FSU can't challenge it. Only they filed it before FSU filed their complaint, so how could their complaint possibly be in response to anything tangible? From what I have read, neither...
As of last year USC paid their TE coach 400k. Elliott was making over 800k as GSU head coach. It's certainly going to be a pay cut. Feels like another case of college head coaches who just don't want to do that sh** anymore.
Our offense last year was 33rd in OFEI, 34th in total offense, and 43rd in scoring offense. I think against a tougher schedule we will have to improve on offense to maintain those numbers which I actually do think we can do. When you start throwing top 25 and top 15 in there as expectations when...
Our offense broke 35 last year 3 times in 13 games against defenses ranked right around 50th in the country on average in DFEI. The defenses we play next year average around 40th in DFEI based on their 2023 numbers and you are expecting to average 35 a game against them? Not really sure that is...
What is the reason we should expect a top 25 offense? We weren't top 25 last year, didn't really add anyone that would make an immediate impact, and the quality of defenses we will play will likely be higher. It's going to be a grind. A top 25 offense would be a pretty outstanding job by our staff.
Yeah, they are interesting. They are actually the only ACC team we play this year that will have the same QB as last year. In a new world of college football basically shuffling the deck every year, they managed to find some continuity.
